How To Accept a Home Downpayment Gift That Won't Get Rejected In Underwriting

Over the past 2 two years, mortgage guidelines have tightened and one of the lasting impacts on home buyers is that it now takes a larger downpayment to buy a home.

It's as true for conventional home loans as it is for FHA ones -- banks want to see more of home buyer's own skin in the game.Unfortunately, not every buyer has the cash.

This is one reason why -- anecdotally -- the number of home buyers asking for "downpayment gifts"  from family members is rising. With home prices down, mortgage rates low, and a generous first-time home buyer tax credit in place, there's a lot of would-be homeowners that don't want to miss out on the action.
However, if taking a gift of downpayment is part of your upcoming home financing strategy, you need to know that there's a right way and a wrong way to do it.  You can't just deposit your parents' money into a bank account.

Accepting cash for a downpayment is a 3-step process.  Follow the steps to a tee, or expect an underwriter to disallow the gift as a source of downpayment.

First, complete and sign an acceptable gift letter.  There are lots of variations on the "Downpayment Gift Letter" but each follows the same basic format.
  • Includes the amount of the gift
  • Includes the subject property address
  • Includes the relationship of the gifter to the giftee
  • States that the gift is actually a gift and not a loan
  • Signed and dated by all parties
If you don't have a template gift letter on-hand, send me an email and I'll forward you the one I use for my clients.

Next, with the gift letter in place, the gifter should to make an extra strong paper trail for the money being gifted.  This is one reason why certified checks are preferable to wire transfers.  Both are acceptable methods of gifting, but certified checks are easier to document and simpler to prove  -- all it takes is a teller receipt.
Make sure the amount of the gift matches the amount specified on the gift letter.

And, lastly, when receiving the gift, the giftee should be careful to accept the gift as-is.  Deposit it with a live teller in a branch bank and make sure the deposit is not commingled.  If the gift is for $10,000, for example, make a $10,000 deposit -- nothing more, nothing less.  Don't add a random $100 check to the deposit, in other words.

Follow these 3 steps, though, and everything should be fine.

Meanwhile, there might be legal and tax liabilities when gifting funds between family members.  If you're unsure about how donating or receiving a gift might impact you, be sure to talk with your attorney and/or accountant.

The Moment of Truth.

Need and the Perils of Over-Pricing

I sat at the kitchen table with my client.  We had been in contact over the last several months as he fixed up the home that renters hadn't cared to keep up.  They had, indeed let the dogs use the floors instead of going outside, and smoked like chimneys in the home.  He restored it better than new.

It was truly a labor of love for him, rebuilding window boxes, painting, re-doing the kitchen, adding brand new carpet throughout.  The results were spectacular.  Any buyer would be proud to purchase it.
We poured over the recent sold data in the area and I suggested a price range.  "But, I can't," he said with a sigh.  "Ipink piggy bank owe $Xxx,000.  I need to price it about $25,000 higher than you are suggesting.  Let's do that and see what happens."
The Moment of Truth.  Many agents have been here before.  As have many sellers.

For whatever reason, it is time to sell a home.  Maybe you are moving up, down-sizing, relocating.  Maybe you have grown weary of the late night calls when the toilet overflows, and you don't see the upside to a property management company.  Whatever the case, one must determine a price.

 So, what's wrong with "seeing what happens"?  

A few things:

  • In many markets, the buyer has a lot of inventory to choose from.  Buyers will start their search in with a certain number of beds and baths, and a price range.  If your home is over-priced for the area, your home will help sell other homes.  Imagine going to see a $250,000 home with 3 beds and 2.5 baths, and 2200 square feet.  It's clean and has a lot of upgrades, including new paint and carpet.  Just down the street is another home listed at $255,000.  Except this one has 4 beds, 3 baths and 2900 square feet, plus an unfinished basement.  It needs paint, but the appliances are in good shape....  Which do you think might appeal to you?
  • Even if you don't "have to" sell your home, you are competing with others who do.  Imagine the first home in the scenario above.  Now imagine that on the next block there is a home with the same floor plan, square footage and beds and baths.  Except this couple is getting a divorce and they want to get as far away from the home (and each other) as they can.  They've listed theirs at $205,000, even though the comps in the area are closer to $225,000.  Do you think the buyers will go for the $205,000 or that $250,000?
  • Your home will sit on the market.  For awhile.  When homes sit on the market for many months and other homes around it are selling a few things happen.  First, it's a lot of work to keep your home listed and the payments that you will continue to make start to add up.  Second, agents and buyers start to see it as stale, and may even start to assume something is wrong with the home.  Especially when the buyer and agent see the continuing price drops over the months with no action.
The truth is that your home is only worth as much as a buyer is willing to pay.  And even then, if the buyer is using a lender, the lender will order an appraisal.  If your house doesn't appraise, the buyer may not be able to cover the difference and may decide to walk away.

90% of today's buyers preview a home by viewing photos on the Internet before deciding whether or not to visit the home in person.  With the number of houses on the market today, realtors and home sellers have only two options to sell a property--reduce the price or stage it.  Staged homes sell faster and for the most dollars.  On average, professionally staged homes sell 50% faster and for 6-10% more money than non-staged homes.  Home Staging is reported to be the third most valuable home improvement project to a seller when it comes to selling a home.  

In staging a home, my goal is to accentuate every positive feature of a home and neutralize any negatives.  I view every aspect of a home through the eyes of a potential buyer.  Then, by combining interior design principles and marketing concepts I "set the stage" in every room to showcase the entire home.  Starting with existing interior furnishings I concentrate on furniture placement, balance, color harmony, and accessories, all to make potential buyers fall in love with the property.

A Warning To All Home Sellers……..

As the Spring home selling season begins to move in let me offer this up to you. Railroad crossing Just like in the days of old when coming to a railroad crossing there was a sign a sign that read “Stop….Look….Listen”.  It was a warning that there is a possible danger ahead and you needed to heed the sign and the possible danger.
Just like that sign with the flashing red lights when a train was approaching is a warning; we can use the same analogy when it comes time to list your home for sale in the current market place.

Here are 5 of the top reasons why a buyer will pick the house they buy:

Reason #5 ----- Shopping, we all shop out of both need and desire.  So we will look at how close we are to grocery stores, malls, restaurants, etc.

Reason #4 ----- Work, what is the proximity to their current employment or the diversity of jobs and the overall stability of jobs in the area.

Reason #3 ----- Schools, highly rated and a diversity of schools adds to the overall market demand for a particular area, especially for home buyers with school age children.

Reason #2 ----- Neighborhood, pride of ownership of the homes in your neighborhood will attract or detract buyers.  Are the homes similar in style and age, etc. or is there a real difference?

Reason #1 ----- Price, believe it or not PRICE still ranks higher than location in most studies on this issue.  Pricing you home for sale is the most critical part of placing your home on the market.  You may have the best looking home in the subdivision and the best yard and all of the bells and whistles BUT, if it is not priced aggressively it may not sell as quickly as you would like!

Of the 5 reasons mentioned above, you the seller have control over only one…..PRICE…..so price it right from the start while it is fresh to the market.

As a seller coming on the market it would be advisable to heed the flashing red lights.
